These Terms and Conditions govern the supply by us of any Product ordered by you on the Site. By agreeing to order a Product, you agree to be legally bound by these Terms and Conditions. You hereby acknowledge that you have read and accepted these Terms and Conditions.
When placing an Order, you must register for an Account on the site as detailed on the Site and you must follow the instructions on the Site as to how to make your order. If you do not agree to these T&C, do not register with or continue to use the Site. At the time of placing the Order, the transaction details are presented to the bank and an authorisation is obtained for the amount of the Order. If such authorisation is not obtained, the Order will be cancelled. If authorisation is obtained, payment is usually immediate.
Marlboro Originals shall take all reasonable efforts to ensure that when stock is no longer available, that offers thereof are discontinued. However, should Marlboro Originals be unable to fulfill any Order placed by you at the advertised price due to stock having been sold out, Marlboro Originals will notify you and you will be entitled to a refund of the amount paid by you for such product.
As a Member, the Site will enable you to place electronic orders (“Order”) for one or more Products offered, for so long as such Products are still available and not sold out. A purchase agreement between you and Marlboro Originals (“Purchase”) only comes into effect if you electronically submit a properly completed Order for one or more Products in your shopping basket and payment is either authorised or received by Marlboro Originals into its bank account, subject to stock of the Product concerned being available.
5.1 We reserve the right, for purposes of preventing suspected fraud, to refuse to accept or process payment on any Order and/or to cancel any Sale concluded between you and Marlboro Originals, in whole or in part, on notice to you. Marlboro Originals shall only be liable to refund monies already paid by you in respect of the cancelled portion of the Order (see Marlboro Originals’s Returns Policy in this regard).
5.2 You are entitled to cancel any Order/s or Purchase/s as provided for in the Returns Policy.
The price of each Product is displayed with the Product listing. In the event of a sale or special offer, the discounted price is displayed.
Marlboro Originals shall take all reasonable efforts to accurately indicate Purchase Prices and delivery charges. However, should Products be erroneously offered at incorrect Purchase Prices and/or delivery charges, Marlboro Originals will not be obliged to sell Products at such incorrect Purchase Prices and/or delivery charges. Marlboro Originals shall only be liable to refund monies paid should you not wish to proceed with the Purchase at the correct Purchase Price and/or delivery charge.
Purchases may currently be paid for by credit cards.

You warrant that you are fully authorised to use the credit card supplied for purposes of paying for your Order. Also, you warrant that this credit card has sufficient available funds to cover all of the costs incurred as a result of using the Services.
As Purchaser, you will be able to specify the place of delivery, and the contact number(s) to be used in relation to the delivery, for each Order when you place such Order. Products will be delivered to the delivery address specified by you during the Order process. If nobody is at the address when the delivery is made, our courier will contact the contact number you provided and/or a notice of attempted delivery may be put in the letterbox. If delivery is unsuccessful, it will be your responsibility to contact the courier company to either arrange that you collect the package from the courier’s nearest depot or to agree upon a new delivery date with the courier. If you have not contacted the courier within a reasonable time, then the package will be sent back to Marlboro Originals. You will then be contacted via email to arrange a possible re-delivery at your expense.
Orders received will be processed and dispatched within 3 days of receipt thereof. All shipping services used by Marlboro Originals provides a tracking number and insurance service for the cost of your package.Marlboro Originals may also notify you of the dispatch of your Order via email (to the email address we have on record for you) summarizing the Products sent. Marlboro Originals will not accept any liability for any delays in the delivery of goods after shipment caused by matters beyond their control.
You will be informed of the partial delivery of an Order by email. A second email will be sent informing you of the delivery of the other Products ordered, if applicable. In the event of a partial delivery, there will be a delivery note in the package summarizing the Products inside.
Each delivery is deemed to have been made once the Product has been handed over to an individual at your chosen delivery address, including when this is done by the courier, as recorded in the tracking system used by the courier.
It is your responsibility as Purchaser, to ensure that you check the package upon arrival and make any reservations and claims which might appear to be justified. You can even refuse the package if it is likely to have been opened or if it shows clear traces of damage. The aforesaid reservations and claims must be sent to the courier by a registered letter (with acknowledgement of receipt) and a copy of this letter must simultaneously be sent to Marlboro Originals.
If neither the depot nor the tracking system (in the "My Delivery" section) show any trace of the package, you must then get in touch with Marlboro Originals by way of email to firstname.lastname@example.org or by contacting the Head Office at 27 21 593 8826.
If the package is found, it will then be sent to the specified delivery address, following the normal procedure as set out in clause 8.1 (i.e. delivery of the package or notice of attempted delivery).
If the package is declared to be lost, Marlboro Originals will notify the Purchaser and refund the Purchaser for the lost package (both the Product purchase price and any delivery charges).
All products need to be returned within fourteen (working) days of receipt. Please refer to the Returns Policy, which regulates your rights in this regard.
SOUTH AFRICAN ORDERS
Orders placed for delivery in South Africa will be sent by door to door courier. Orders received will be processed and dispatched within 3 days of receipt thereof.
Delivery times - 3 to 7 working days.
Delivery Cost - Free
Orders placed for delivery to countries outside South Africa will be sent by Expedited Mail Services, door to door. Orders received will be processed and dispatched within 3 days of receipt thereof.
The recipient will be phoned to arrange an appointment for the delivery of the parcel. It is therefore important to supply us with a valid contactable telephone number and street address. Any duties and/or clearing charges will be for the account of the buyer.
Courier Airfreight (DHL)
Delivery times - 3 to 7 working days.
Delivery Cost - $25.00 Flat rate (approximately R330).
Standard Air Parcel Post
Delivery times - 7 to 14 working days.
Delivery Cost - Free
We will gladly accept returns or exchanges for online purchases within 14 days of delivery and in the case of returns you will be refunded in full upon receipt by us of the returned items. If your return exceeds the 14 day period , you will receive a credit for the full amount of the item. Please return merchandise with original swing tickets and packaging, unwashed and unused. Shipping and handling charges are non- refundable.
How to return an item:
All returns must be authorised by Marlboro Originals. Please send your return request to email@example.com with your order number and list of the items you would like to return. Upon receipt of a confirmation email, pack the merchandise in the original package if possible and send prepaid and insured to

How to exchange an item:
Because of the limited nature of many of our products, if you are interested in making an exchange, we recommend sending us an email at firstname.lastname@example.org o.za to request authorisation of your exchange and confirmation that your desired size and item for exchange for are in stock. Upon receipt of a confirmation email, please send your original merchandise, unwashed and unworn to us at the address above. Please include a detailed note of the size/item which you would like to exchange. There will be a R300.00 charge for shipping and handling for all international exchanges (Local exchanges R94.00) which will be charged to the card used in the original purchase.
Marlboro Originals will not accept responsibility for reimbursement or compensation of lost packages without proof of delivery. When your return is received, we will credit the card used to make the original purchase . Marlboro Originals will process your return immediately but the time it takes for the refund to post to your account may vary depending on your bank and/or credit card company.
A full record of every Purchase and related transaction between you and Marlboro Originals shall be maintained on the Site for a period of 12 months following the date of such Purchase or related transaction. You can view and print such record during the 12 month period, where after you are responsible for retaining your own record of the relevant sale or related transaction. Marlboro Originals's registration documents and the Site's registered domain name are checked and verified by Thawte.
Save for Marlboro Originals being liable to you –
neither Marlboro Originals nor any of its agents or representatives shall be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use this Site or the Services or content provided from and through this Site. Each and every provision of these Ts&Cs shall be deemed to be separate and severable from the remaining provisions of these Ts&Cs. If any of the provisions are found by any court of competent jurisdiction to be invalid and/or unenforceable then, notwithstanding such invalidity and/or unenforceability, the remaining provisions of these T&C shall remain of full force and effect.
